History of Medical Law

The first record of medical law dates back to around 1754 BC and originates in the Code of Hammurabi. The statement read as follows: “If a physician makes a large incision with the operating knife, and kill him, ... his hands shall be cut off.” Since then, the field of medical law has expanded and become one of the largest branches in all legal proceedings.

Confidentiality

As stated, confidentiality is one of the most common subjects in medical law. Historically, all medical professionals are subject to confidentiality and have been prohibited by law to divulge any information regarding their patients and their care. Recently, this statue has been expanded to include any statements from patients to physical or mental healthcare professionals must be kept confidential. The only exception to this is if a patient were to express an imminent intention to harm themselves or others.

The Health Insurance Portability and Accountability Act (HIPAA) has further reinforced confidentiality and was developed in order to cope with the increasingly mobile and well-connected world we live in. Medical records, for example, are now largely stored in online data bases and are easier to access from remote locations. HIPPA has introduced several new formal requirements regarding all disclosures (ways in which information can be exchanged). If this act is violated, those involved can face significant liability.

Negligence and Other Torts

Another legal aspect of medical law includes negligence and other torts. Professional healthcare providers are held to a higher standard for diagnosing and treating others than a passerby on the street that may render assistance. When a medical professional is negligent in the diagnosis or treatment of a patient which results in the injury or death of that patient, the medical professional is held liable. This form of negligence is referred to as medical malpractice. Medical malpractice is the most common area of medical law and cases are brought up frequently.

Aside from medical malpractice, there are other torts which cross over into medical law. Defamation can occur in medical law if a medical professional were to wrongfully disclose falsified information regarding the patient’s health. Battery can occur in medical law when a medical professional performs treatment on a patient who has, for any reason, declined the treatment. This is often seen in cases where a patient’s religion restricts them from receiving certain treatments. Each of these torts holds medical professionals liable and it is important when practicing medical law to be aware of and prepare for these cases.
