Liability, Risk Allocation, and Sources of Recovery for Property Damage Sustained During a Construction Project
Do you know who pays the bill when an independent contractor causes property damage during a construction project? Construction projects of all types and sizes pose the risk of property damage caused by participants in the design and construction fields. Understanding which participants are liable for redressing damage, how participants may allocate the risks of liability and damage, and how participants may or may not be compensated for damage are topics which any individual working in the design and construction fields should understand at a basic level. This topic provides an overview of which entities may be responsible for property damage caused by an independent contractor and why, how construction participants may use written contracts to allocate for the risk of property damage through the use of indemnity, warranty, limitation of liability, and insurance provisions, and how various insurance coverages – including first party property insurance, builders risk, OCIP and CCIP, commercial general liability, and professional liability insurance – may or may not provide compensation to redress property damage.
